Erin Shanley, Partner

Ms. Shanley’s practice primarily involves Administrative Law and Workers’ Compensation Insurance Defense, including representation of insurance carriers before administrative tribunals and consulting on compliance and regulatory requirements. She represents insurance carriers, certified self-insureds, third party administrators, and employers in matters involving indemnity benefits and medical benefits liability within the Texas workers’ compensation system.

Dan Price, Partner

Mr. Price practices civil and commercial litigation, handling a range of cases from complex commercial and reinsurance disputes to insurance defense, workers’ compensation, regulation, and subrogation matters. He has represented clients in state and federal courts and administrative agencies throughout the country as both lead counsel and as a member of litigation teams. Particular areas of interest and experience include workers’ compensation, insurance insolvency law, state guaranty associations and guaranty funds, and fiduciary litigation. Mr. Price is a native of Austin, Texas where he and his wife, Anna, work together to serve their community.

  • Special litigation counsel to bankruptcy trustee in successful prosecution and settlement of fraudulent transfer litigation under the Uniform Fraudulent Transfers Act, to recover on behalf of the trustee principal assets of the debtor transferred to related entities and concealed from disclosure to the bankruptcy court.
  • Past experience includes serving on litigation team representing insurance receiver in asset recovery litigation prosecuted through federal multi-district litigation (MDL) with causes of action including RICO, breach of fiduciary duty, mail fraud, wire fraud, professional malpractice, among others.

Amy Cadwell, Associate

Ms. Cadwell practices administrative, civil, and commercial litigation and appeals, focusing on Workers’ Compensation Insurance Defense. With a background in criminal prosecutions at both the state and county level, she has experience in a wide range of issues including insurance, fraud, theft, and tort litigation. Prior to joining Shanley Price, Ms. Cadwell was a criminal prosecutor for 10+ years before working on the opioid lawsuits. Now, she works mostly with insurance carriers, third-party administrators, and employers advocating on their behalf in workers’ compensation litigation and in all appellate matters.

Shanley Price attorneys are often called upon to advise on legal compliance, including handling Performance Based Oversight (PBO) audits and defending against allegations of non-compliance.

Shanley Price provides assistance in recovery of worker’s compensation liens for insurance companies and self-insureds, including intervening to protect the lien, as well as negotiating allocation and treatment of the third-party recovery to maximize subrogation recovery, credits, and reimbursements.

Shanley Price has significant experience representing insurers in judicial review of workers’ compensation cases appealed from the agency level, including both trial and appellate practice.

Our attorneys are keenly adept in advising on claims exposure, providing legal counsel in all aspects of a workers’ compensation claim, and in turn, assisting to posture each case for the best possible outcome. Services include advising on legal compliance, providing coverage opinions, preparing Designated Doctor and Post-DD RME requests and position statements, and providing comprehensive case analyses with recommendations for controlling medical and indemnity benefits exposure.

Shanley Price represents insurance carriers and certified self-insureds in all types of benefits proceedings before the DWC, including Benefit Review Conferences (BRCs), Contested Case Hearings (CCHs), Medical Contested Case Hearings (MCCHs), and in matters appealed to the State Office of Administrative Hearings (SOAH). Collectively, our attorneys have handled thousands of such proceedings and stand ready to provide a skillful and effective defense.
